Members Present:  Edward Clancy-Chairman,  David Williams, Lawrence Roy, John Skarin, and Priscilla Ryder-Conservation Officer

Absent:  Allan White, Donald V. Rider, Jr., and Dennis Demers

Discussion:
§       Bret Bugmack – Eagle Scout from St. Johns High School is proposing to do his Eagle Scout project installing the remaining storm drain markings in the Fort Meadow watershed.  There remain 55 streets to do with over 400 more markers to install and door hangers to hang.  The door hangers explains why catch basins must be protected from oil grease etc, because it drains to the lake.   The Commission voted 5-0 to approve the project and thanked Brett for choosing to do his project with the Marlborough Conservation Commission.

§       120 Bartlett St. –  Brian Gagne of RAM management  and Brad Mezquita of Apple D’Ore Engineering explained that they are interested in renovating the Butcher Wax building to accommodate several different uses and will need to expand the parking lot.  However, there are wetland constraints on the site so they wanted feedback from the Commission prior to investing money on redesign.  They will need to do some wetland filling.  Arthur Allen of EcoTech has reflagged the wetland and noted that the replication of the wetland filling could be near the detention/wetland pond area on the west side of the building.  They anticipate 2100 sq. feet of wetland filling.  The Commission noted that a Notice of Intent would need to be filed both in Marlborough and Northborough.  Wetland filling is not normally permitted if a non-wetland filling alternative is available.  If none is available the applicant must prove that the new design includes mitigation and environmental improvements that outweigh the wetland filling loss.  The onus would be on the applicant to make that argument.  The presenters thanked the Commission for their time and will likely file a Notice of Intent soon.

§       Letter from Dr. T.B. Spahr-  RE: Felton Conservation Land and birding, dated Aug. 28, 2003.  The Commission reviewed this letter which provided a list of birds observed at the Felton Conservation Land and an offer to provide some funding to help improve the habitat, or a bird viewing facilities.  The Commission discussed the usefulness of a bird-blind as discussed in the letter and asked Ms. Ryder to investigate whether that is a good ecological means of improving bird viewing, or if other items such as using the funding to remove invasive species would be more helpful.  She will look into it and report back to the Commission and Dr. Spahr.  

§       Richer School – DEP 212-922   Tom Andrade provided the Commission with a slight change to the emergency access roadway to Richer School.  If the roadway is shifted

5 feet closer to the wetland boundary, it will allow the existing play ground equipment to remain undisturbed.  The Commission noted that this area is already a maintained field and that the shift closer to the wetland will not impact the wetland significantly.  Therefore, the Commission voted 5-0 to approve these plans, entitled "Richer School Access Rd. Layout Plan" dated 6/1/2003,  Rev. 6/13/2003 Issued for Bid,  as a minor change not requiring further review.

At the applicants request this item was continued to the October 2, 2003 meeting.

CERTIFICATE OF COMPLIANCE
DEP 212-899  130 Dean Rd. - Ms. Ryder indicated that the work has been completed and the site is stabilized, the Commission voted 5-0 to issue a full Certificate of Compliance.

VIOLATIONS
The commission reviewed the following violation notices and voted 5-0 to accept and place on file:
§       Letter to 488 Farm Rd. RE: Wetland Protection Act, dated Oct. 23, 2003.
§       Letter to 33 Red Spring Rd.  RE: 33 Redspring Rd. Wetland Violation Requirements to file with the Commission, dated 9/8/2003.
§       Letter to 93 Chase Rd.  RE: Wetland Violation – stream in back yard, dated 9/8/2003.

CORRESPONDENCE
The commission reviewed the following correspondence and voted to accept and place on file:  Letter to Stephen Garafalo, RE: Acre Bridge Estates Subdivision, Cook Lane and Farm Rd. Mitigation Measures required.

ANNOUNCEMENT
§       Oct. 4, 2003  Fall Hazardous Waste Collection Day 9-12
§       Ground breaking ceremony for the Assabet River Rail Trail at 2:00 Crowley Dr. (Hudson Town hall if it rains)
